The news published in several mediums that “The Constitutional Court overrules the President’s decree on the dismissal of Avni Kastrati as Kosovo’s ambassador to Slovenia”, is incorrect. In fact, the Constitutional Court has not assessed the constitutionality of the President’s decree at all.
The Office of the President of the Republic of Kosovo was informed today by the Constitutional Court that the petitioner before the Constitutional Court claimed that the regular courts had violated his basic rights and freedoms guaranteed by the Constitution.
As a result, the Constitutional Court has decided to return this case to the Basic Court in Prishtina. Hence, under no circumstance are we dealing with an overruling of the President’s decree, since the Constitutional Court has not as yet assessed the constitutionality of the President’s decree.
