President Osmani has appointed eight members of the CEC

The President of the Republic of Kosovo Vjosa Osmani, in accordance with the constitutional and legal competencies, has appointed eight members of the CEC. These appointments have been made in accordance with the proposals made by political entities in a manner stipulated by the laws in force. There is a constitutional ambiguity regarding the appointment of the other two members and as a result, the President has addressed the Constitutional Court with a request for interpretation of Article 139, paragraph 4 of the Constitution of the Republic of Kosovo, based on Article 84 and Article 113 of the Constitution.
As a consequence, the request for interpretation addresses the ambiguities raised in two cases. Initially, the interpretation is required, as per the spirit of the Constitution, of the notions “group” or “groups” interpreted together with the word “may” (in Article 139 (4), in cases when there are less than six political entities represented in the Assembly and which do not have the right to participate in the allocation of reserved seats, and when one group wins over 50% of the vote in an election. Secondly, clarification is required regarding the appointment of a representative of the Bosniak community in a situation when there are three political entities in Assembly representing this community and have an equal number of deputies represented in the Assembly.
 
Upon the receipt of the response from the Constitutional Court, the President of the Republic of Kosovo shall take the necessary steps to appoint the two remaining members of the CEC. The swearing in of the CEC members will take place in the forthcoming days.
